Crestview Estates HOA meeting minutes – April 19, 2016
Members present: President Roger Branch, Vice President Elizabeth Aguilar, Treasurer Bob McLaughlin, and Secretary Tom Vermilye.
Meeting called to order by Roger Branch at 7:15pm.
New PO Box for the HOA – PO Box 3376, Parker, CO 80134
Treasurer’s report – $550 for boundary survey and $114 for sign lighting
Discussion –
Roger, Bob, and Elizabeth met with HOA attorney Kathryn James with the Folkestad Fazekas law firm. Here is a summary of some of the notes from that meeting:
There is a $1500 retainer that we will be paying for their services. They charge $325 per hour.
“Need to bring our HOA into the 21st century” (research CCIOA Statutes governing HOA’s)
According to our current covenants and by-laws, annual dues are mandatory and participation in the HOA goes with purchasing a property in Crestview Estates.
Dues are used to support our community and it allows homeowners the right to vote on issues affecting the neighborhood.
Current clause in covenants requires an annual assessment that should be handled through a clause in the purchase contracts of homes. Dues are currently $50 per year.
Recommended that policy be developed that separates the HOA Board from the Architectural Control Committee (ACC). These should be two separate entities with the ACC reviewing projects and the HOA Board should be responsible for enforcing covenants and violations of said covenants.
Policies can be created by the HOA Board to provide direction to residents on what is or is not allowed in the neighborhood (i.e. A hog farm)
Research will be done by the Board to determine whether or not we should adopt HOA rules and regulations outlined in a 1992 CCOIA law. The attorney said these rules and regulations may not be in our best interest; therefore, it will be researched before any proposals are made.
Regarding enforcement, the attorney agreed that a clause can be written into our covenants or policy and procedures, stating that if the HOA provides documentation that it has done their due diligence in trying to resolve an issue with a homeowner and legal action is taken; it would require a homeowner to pay the HOA’s legal fees in the event that the HOA needs to file a suit for non-compliance with a violation. Regardless of the outcome, the homeowner would be responsible for the HOA’s legal fees.
The Board will be reviewing the current covenants and by-laws, and any proposed changes will be submitted to the attorney for review. The attorney will provide direction as to which items can be voted on by the Board, and which items will need to be voted on by the HOA members.
Bob and Elizabeth will be researching other HOAs in the rural community, to look for language or suggested changes that we can use in the documents that we submit to the attorney for review.
Based on the location of the survey stakes on the northeast side of the neighborhood, at the end of Pikes Peak Drive, Roger is going to contact Parker Water due to the fact that their service road goes straight through the property line for our neighborhood. The purpose for contacting Parker Water is so we can get some direction as to how they would like us to proceed with the installation of fencing at the end of Pikes Peak Drive.
The two fencing projects, one at the end of Pioneer Drive, and the other at the end of Pikes Peak Drive, will commence once Danny Larson returns from sunny Arizona. Currently, the design of the fencing involves 3 rail white vinyl fencing with a restricted opening for pedestrians and equestrian users. This will be consistent with the current fencing at the end of Devils Head Drive.
In order to preserve the location of the survey stakes, Roger is going to install T-posts in the same locations, so they are more permanent and the weather (and people) cannot alter their locations.
Neighborhood reminders –
Annual dues of $50.00 per household are due at this time. Please mail your dues to the PO Box listed above, or hand deliver them to a Board member so they can be forwarded to Treasurer Bob McLaughlin.
** Annual HOA meeting scheduled for Tuesday, June 28th at 7pm at Faith Baptist Church** (same location as last year) – elections for Board members will take place at this meeting.
